Case

1. As the bankruptcy administrator of a state-owned joint-stock enterprise, Lawyer Li resolved conflicts among shareholders and promoted the transformation of the bankruptcy liquidation case into a bankruptcy restructuring case. Eventually, the full repayment of employee claims, tax claims, and general claims amounting to 230 million RMB was achieved, and the debtor enterprise was revitalized. This case received high recognition from the court and was included in the Top Ten Bankruptcy Typical Cases of the Shanghai Railway Transport Court (2018 - 2022).

2. As the bankruptcy administrator of an industrial company, Lawyer Li skillfully took over the debtor's industrial properties. Through innovative measures, the core assets of the industrial land were retained for bankruptcy restructuring while the non-core assets were spun off for continued liquidation, achieving a perfect combination of the efficiency of the bankruptcy restructuring process and the benefits of debt repayment. As the bankruptcy administrator of an energy technology company, after taking over, Lawyer Li discovered through review that the debtor had committed preferential settlement acts as stipulated in the Bankruptcy Law. He filed a lawsuit to revoke individual settlements according to the law and obtained court support.

5. Representing an insurance company for its subrogation claim of 400 million RMB in general claims from a real estate trust financing project after compensation, through pre-restructuring planning and negotiation of debt transfer during the pre-bankruptcy stage of the real estate development enterprise, the debt repayment rate was efficiently increased from zero (expected execution/bankruptcy liquidation) to 18%.

6. Handling an insurance subrogation claim dispute of an insurance company regarding guarantee insurance business, involving an amount of over 100 million RMB, and achieving good enforcement results.

7. Representing a financial company in handling Internet financial lending disputes. The Internet court fully adopted the opinions on the identification of the authenticity of borrower identities on the Internet financial platform.

8. Handling an entrusted wealth management contract dispute with a asset management company in Shanghai. Since the shareholders of the company failed to perform their liquidation obligations after the company's business license was revoked, the court ruled that they bear joint and several liability for the company's debts.

9. Handling a warehousing contract dispute with a international freight forwarding agency in Shanghai. During the compulsory enforcement stage, the court was successfully requested to add shareholders whose subscribed capital contribution period had not yet expired as defendants. This is the first case of adding such shareholders in this enforcement court.

10. Representing a listed power equipment company in resolving a contract dispute, listing the entrusting purchaser as a co-defendant, and ultimately successfully obtaining the disputed interests.

11. Representing a company in Shanghai in resolving an ownership dispute with the lessor (in an urban village renovation project). In the context of the client's lack of knowledge of the true case details and information asymmetry, Lawyer Li conducted investigations and evidence collection, obtaining unexpected expropriation benefits for the client.

12. Representing a municipal engineering company in Shanghai in a construction contract dispute with a Group in Shanghai. The claim that the reward and punishment clause in the internal contracting agreement of the construction unit was invalid was fully supported by the court.
